Board Likely to Decide on Management at 12/14 Meeting

The Cedar Run HOC board will reportedly try to make a final decision on management at their 12/14 board meeting.  There are five total candidates being considered, which include HHSG (who formerly served as receiver).

The names of the management companies under consideration will not be published on this blog, out of respect for the privacy of the candidates (this is a public website and could affect search engine results).   However, Cedar Run homeowners are welcome to email the blog team at restoreCR@gmail.com for a complete list of candidates.

All owners are encouraged to attend the 12/14 meeting.  Normal board business will be conducted at the meeting, followed by a homeowner session.  This session will be an opportunity for homeowners to provide final comments or feedback before the board debates its management options.  The board may decide to have these discussions/debates in a closed session, but the results will be announced immediately thereafter.

HOC Board to Interview Management Companies

Notice was sent to all Cedar Run unit owners, which included the date and times of four meetings with prospective management companies.

Tonight (Wed 11/16) will be the first of these four meetings.  All owners are welcome to attend and observe as the board members interview the management companies.  These interview meetings are the result of the efforts from the HOC board's management committee.  Reportedly, they have met with several management companies, and they have narrowed the search to these four finalists.  (HHSG is a fifth finalist, and they have already presented to the board)

All meetings are at the Cedar Run clubhouse.

Meetings like this, in the presence of homeowners, are unprecedented in Cedar Run.  This is a level of transparency that most owners have never seen.  Contrast this to the three years of Sher/Shaw conducting any and all board business in private (which happens to be illegal).  Given this history, all homeowners are strongly encouraged to attend these meetings and provide feedback.

It is also widely believed that many of the Cedar Run phase association will consider hiring the company that is selected by the HOC board.  The impact of these interviews could be quite profound.

Cedar Run HOC Board Meeting Tomorrow

Tomorrow is the 2nd Wednesday of the month, meaning that it's board meeting time!  Since receivership officially ended as of 11/1, this is technically the first board meeting with a fully empowered board.  As always, we encourage all homeowners to attend.

We can probably expect an update on parking and the search for management.

We have also received word that HHSG will give a brief presentation, immediately following all board business.  HHSG is currently under a short-term, interim management agreement with the board.  It is our understanding that they will be presenting the board with a proposal to manage the HOC for the long term.  Board members have indicated that HHSG is one of the management candidate that they are considering.

It is also our understanding that some of the limitations to HHSG's management ability within that last two years were due, in part, to the legal constraints of receivership.  Our experience with them may be somewhat different now that receivership has ended.  Perhaps this will be better explained during the presentation.

Cedar Run Receivership Ending on 11/1/16; HHSG Hired on Interim Management Agreement

It is Finally Ending!!

Cedar Run HOC was placed in receivership by the court in February of 2015 due to egregious and blatantly illegal activities by the Sher/Shaw group that was in control at the time.  This receivership order will expire at 11:59 PM on October 31, 2016, thus putting the elected board (voted in on August 4th) in full control of all HOC operations.

HHSG, the company that was assigned by the court to act as Receiver, will officially become Cedar Run HOC's management company and report directly to the board of directors.  They will no longer be an agent of the court as far as Cedar Run management operations are concerned.

Although the board has signed a management agreement with HHSG, the board is still considering  other management companies.  At the request of the board, HHSG agreed to a short term, interim contract with the Cedar Run HOC.  This contract has a "60-day Opt-out" clause, meaning that the board can terminated it within 60 days after giving written notice.  The purpose of this agreement was to give the board more time to make an informed choice on future management.

Things to note about Cedar Run HOC management:
  • The board has formed a committee with the sole purpose of exploring management options and reporting back to the board members.
  • As described by committee members at the 10/19 board meeting, the committee is also evaluating candidates' viability to manage Cedar Run's eleven Phase Associations.
  • Per the board's decision at the 10/19 board meeting, the committee will select companies as finalists that will be interviewed by the board at open meetings (i.e. homeowners are welcome to attend).
  • While HHSG is currently working under an interim agreement, they are also being considered as a candidate (potentially a finalist) for the long-term management of Cedar Run.


***Important Change to Payment Instructions***
By now, all Cedar Run unit owners should have received a statement from HHSG, which includes payment instructions.  Some important things to note:
  • All owner account numbers have changed.
    • While the payment address and general instructions have not changed, Unit owners will need to indicate their NEW ACCOUNT NUMBER (found on the statement) to ensure their payment posts properly.
  • The balance on this latest statement may not be correct.
    • It does not reflect any balance that owners may have had during receivership.
    • Those balances will eventually carry over, but there may be some formalities with the court before that can happen.

Cedar Run Update: Next Master Board Meeting - 10/19

The main agenda item for the meeting will be the official adoption of the FY 2017 budget.
  • You'll notice that this meeting is one week later than normal (third Wednesday rather than second Wednesday).
    • This was done to allow sufficient notice to all homeowners regarding the budget.
    • By law, homeowners must receive a copy of the proposed budget at least 30 days before its adoption.
  • There will be NO INCREASE to the HOC monthly assessment fee for FY 2017. It will remain at $125/mo.

Parking Program
In other News, parking registration has begun for those who wish to lease (or renew) a reserved parking space.
  • All owners applying for or renewing their leased parking space must bring proof of their vehicle registrations to the clubhouse.
    • All registrations must be current, and all vehicles must be registered to the owner's Cedar Run address in order to be eligible.
    • You must have at least three vehicles with current registrations to be eligible for a street space.
  • The cost ($120) and rules are mostly unchanged from this last year with one additional compliance requirement:
    • Anyone applying for or renewing a space must also make an appointment to have an HOC employee inspect their garage interior to ensure that it can fit a vehicle.  Photos will be taken and kept on file to document compliance.
      • This inspection requirement is intended to ensure compliance to the existing rule - which states that all owners must first use their garage and driveway space before being granted street parking space.
      • The use of Cedar Run Garages for storage, living space and purposes other than storing a vehicle seems to be quite widespread.

The election on Thursday, 8/4, was well attended and fairly officiated.  Twelve (12) new board members were elected.  The board then convened and selected officers among themselves.

Statement from Candidate Rob Schulman

The following statement was written by Robert (Rob) Schulman, candidate for the 8/4 election, who recently co-wrote and sent a postcard to all Cedar Run homeowners.

Dear Homeowners,

Thank you for taking the time to read my statement, and thank you  to the blog crew for allowing me to post it here.

It has been nearly FOUR YEARS since Cedar Run had its last Master Board election!  But we are finally rounding the corner to August 4th, when we can vote in a new board that will make important decisions about the future of our community.

We've spent about 18 months in receivership and had a majority of our funds depleted as a direct result of irresponsible, impulsive, self-serving decisions and the legal ramifications of those decisions.  These decisions were made by Robert Sher and Jack Shaw, and ratified by a board of directors who were fooled into thinking they were doing good or were bullied into submission.

I could ramble on for days about all that was done under Sher and Shaw, but here are just a few highlights:
  • ILLEGAL & improper collection of phase assessments that resulted in unprecedented delinquency rates and a collection crisis that got several homeowners evicted.
  • Creation of ILLEGAL bylaws that benefited Sher & Shaw and a few others, while giving a raw deal to Cedar Run homeowners. [Admin comment:  These Bylaws can be viewed by clicking HERE]
  • Signing of an ILLEGAL contract, that guaranteed Sher and Shaw would stay on the payroll for 8 YEARS!!  [Admin comment:  This contract can be viewed by clicking HERE]
  • About a dozen lawsuits (including the one that landed us in receivership) that have cost well over a quarter million dollars of homeowner money thus far to settle.
  • All the IRS problems, payola & graft, accounting blunders, and outrageous incompetence outlined in the 30 page accounting report. [Admin comment:  The FR&R report can be viewed by clicking HERE]
  • Multiple newsletters, clubhouse presentations, and other propaganda that slandered ME and anyone else who would dare to criticize or question Sher, Shaw, or the board's actions.
  • To top it off, WE PAID THESE CLOWNS about $170 grand for their services!! [Admin comment: "these clowns" were paid $168,920.55 to be exact]
MOVING FORWARD
Now that we have an election, it is vitally important that we learn from the past and make Cedar Run the best it possibly can be.

I stand with my fellow candidates (who also contributed to the cost of the postcards), Jan Kurtz and Jim Hartmann.  I also stand with ANY of the other candidates (be they nominated or write-in) who share my vision to Restore Cedar Run and believe in the following ideas:
  1. Cedar Run must be professionally managed by a qualified company that will provide the service we deserve and a good value.  Homeowner input and feedback is vital in making this happen.
  2. The board must strictly follow the law and not ignore the law when it is convenient or cheaper to do so (which was commonplace in the Sher/Shaw group).
  3. The board needs to be transparent, allowing homeowners to witness and participate in all board meetings.
  4. Cedar Run needs to be clean, orderly, and have clearly established (and enforced) rules, including those that cover rental of units, parking, noise, etc.
  5. An ALL VOLUNTEER board, where no directors are paid.

That said, I condemn ANY candidate whose agenda is to defend the above actions taken under the Sher/Shaw regime and who plans to revert back to them.  MOST KNOW OF WHOM I SPEAK!

WHAT YOU CAN DO TO HELP
You can help ensure that a responsible board is elected by printing, filling out, signing, and returning a proxy that I will use to ensure we end up with a responsible board that will MOVE US FORWARD and make sound decisions, with NO OTHER AGENDA and NO CONFLICTS OF INTEREST.

Nine Days until Cedar Run Election - Candidate Bios Available.

The Election is right around the corner.  Once again, homeowners should have received the following items in the mail.

  1. A list of nominated candidates
  2. A set of rules describing how the election will be conducted
  3. A Proxy with two options
  4. A Letter entitles "Overview of Litigation"
In our last blog post, we focused on the  "Overview of Litigation".  If you haven't already, please scroll down the page and read that blog from 7/20/16.

Our focus this time is on the list of nominated candidates.  No, we won't be going through each name on the list.  We'll let each of them speak for themselves.

What was not included in the mailing was the nomination and qualification info that each candidate submitted.  This information is currently available to view or pick up at the Cedar Run Clubhouse, but we've obtain copies of them for your convenience.

Do also note that additional candidates may participate as write-in candidates.  There will need to be at least one write-in candidate because there are currently 11 nominated candidates for 12 positions on the board.  Write-ins will need to be nominated from the floor on the day of the election, and they will make their statements verbally to the homeowners.

Two Weeks Until Cedar Run Election

By now, all  Cedar Run homeowners should have received a mailing that included the following:

  1. A list of nominated candidates
  2. A set of rules describing how the election will be conducted
  3. A Proxy with two options
  4. A Letter entitles "Overview of Litigation"
Our focus for today's blog post is item #4, Overview of Litigation.

WE STRONGLY ENCOURAGE ALL OWNERS TO READ THIS OVERVIEW OF LITIGATION!

A copy of this letter can be found HERE.

The Overview of Litigation was approved by the court and ordered to be disseminated to all owners.  The issuing of this letter is a very important, necessary step to ensure that all owners understand the legal issues that have plagued Cedar Run over the past four years.  It is critical that all Cedar Run owners can make their decision on August 4th as INFORMED VOTERS.

While there is much detail left out of this letter, it  does provide a concise, factually correct summary of what has happened in Cedar Run, why we are in receivership, and why we are having this election.

Whether you are a long-time owner or a recent buyer, we strongly encourage you to read this Overview of Litigation.

Some items to note within the letter:

The Sher/Shaw group adopted a set of By-Laws in 2012 without notifying or getting approval from homeowners.  These bylaws conflicted with Illinois law and were determined, by the court, to be void.  A copy of these By-Laws (Which we've often appropriately referred to as "The Bogus By-Laws") can be found HERE.

An Exclusive Consulting Agreement was signed in 2012 between the HOC ("Party #1") and Robert Sher & Jack Shaw ("Party #2").  This agreement, even more so than the Bogus Bylaws, essentially guaranteed employment and pay for Robert & Jack for EIGHT YEARS.  It's worth noting that the only signature on the agreement for "Party #1" was Barbara Shaw....The wife and daughter of both members of "Party #2", respectively.  A copy of this agreement can be found HERE.

Robert Sher and Jack Shaw received a total of $168,920.55 for serving on the oversight committee. This figure came directly from a court-approved report by the accounting firm Frost, Ruttenberg & Rothblatt (FR&R).  A copy of the text of the report can be found HERE.

Within the FR&R report, you'll find information that is even more appalling regarding how the Sher/Shaw group handled Cedar Run's finances, taxes, collections, employees, relationships with contractors.  You'll also see that over $218K went to their family's law firm, Shaw Legal Services, and the over $43K paid out to settle judgements that were filed against them by vendors.

The numbers DO NOT LIE, and this was all funded with OUR MONEY!

Cedar Run HOC Election Scheduled for August 4th, 2016

By now, Cedar Run homeowners should have received a notice from the receiver about the election.  This notice should have included a self-nomination form for those who wish to run for a position on the new board.  (We will post a scanned copy of this nomination form on the blog shortly)

We encourage all who want to take part in deciding Cedar Run's future to fill out this form and turn it into the clubhouse before 6/29/16.  We also welcome you to email us at restoreCR@gmail.com if you'd like us to consider posting your information (i.e. bio, qualifications or any statements you'd like to make) on this blog.  If you are unable or undecided by the 6/29 deadline, don't let that deter you from running.  You can still do so as a write-in candidate, and write-in candidates often win elections in community associations like ours.

It has been FOUR YEARS since the last election for this board.  Let's all participate in the process and select the best candidates to move Cedar Run forward!

Road Paving to Begin Week of June 20th

The following announcement (in bold) was passed along to us by HHSG:


"Next week 20-25 June we will be repairing streets and filling pot holes. 

***UPDATE*** Start date now Thursday 6/23 due to weather***

I suspect  based on the weather that the work will begin Tuesday the 21st  Wednesday the 22nd Thursday the 23rd
Jaspen, Zee and Harms Court  will have the top two inches of pavement removed and then repaved. All vehicles must be out of Jaspen, Zee and Harms Court  no later than 6:30 AM, 22 23 June.  Vehicles left in the street after 6:30am will be towed  and the owner charged. Vehicles may return after 7:00 PM 22 23 June.  Parking in the club house is allowed on the 23rd

I will post notices on each unit and parked car on those three courts no later than Friday

No other parking restrictions are in place on other streets."

Update from the Receiver

The following update was emailed to us by the receiver:

  1. Paving repairs are going thru the permit process with the Village of Wheeling (3-4 week process)
  2. Pool passes are required each year since we have to confirm the unit owner is paid in full to the HOC
  3. Trees are being removed due to disease, dead trees can and will be a hazard during storms.
  4. I’ve chosen to hold off on the sign so the new board can choose the design.
  5. Elections should be in July or August, this is a process that requires specific approvals and timing.
Finally please enjoy the beautiful property that you own.  The pool, parks and ponds are beautiful. The clubhouse is available for parties, the landscaping is very nice and the grounds are clean.  Negative comments at this stage indicate a lack of desire to move forward. The HOC is better today than it was and it will continue to improve.

(Quick) Update from Receiver

Quick Update

1) We started towing cars from the club house parking lot

2) Pool repairs are progressing as planned

3) The large pond fountain is under repair

4) Owners can call the tow company to have cars towed from their assigned spot but must give their name and some other info to the driver. 

5) Landscape clean up continues over the next few weeks

6) There is no date planned for the election yet

Update From Receiver

The following information was provided to us by HHSG with instructions to post it for all Cedar Run residents/owners:

  1. We are collecting quite a bit of money from the delinquent accounts lowering the AR balance weekly.
  2. There are only four parking spots not rented for the year.  89, 150, 168 and 175.
  3. I encourage owners to stop by and read or pick up the FRR report. (which can also be downloaded HERE)
  4. Spring cleanup by Landscape Concepts will be done in a the next few weeks.
    • Trees are being planted by mid-April
    • Plow damage to the grass will be repaired after April 15
    • We are mulching the tree rings but not the large maples.
    • Pond fountains will be installed in April
    • Spring flowers will be installed in mid-April
  5. Pool passes will only be issued to residents that are up to date on their assessments.
  6. Towing continues, however we’ve had very few tows in the past few weeks.  People are following the rules.
  7. Security cameras were updated and the system upgraded in the past few weeks.  The cameras were damage by a few teenagers last week.  We have them on camera and the film has been turned over to the police.  Receiver will press charges as soon as the vandals are identified.
  8. The office hours at the club house are Monday  and Wednesday 3:00 – 7:00 pm and Friday  1:00-4:00 pm
  9. The office staff is creating a standard operating procedure manual in order to provide continuity of operations to the new Board.
  10. Election of a new HOC  board is planned for May 2016.



**UPDATE Additional comments below in response to recent owner comments UPDATE**

Good questions are put forth via this blog.  I will answer a few of the points raised. 
  1. Trees are going in where they were removed unless it was not prudent from a landscape perspective to reinstall at the same location.
  2. The tow company will tow cars if they are in your spot or blocking your driveway. 
  3. Call the tow company if you see an issue.  They will come out at some point.  However they are not waiting for calls so they will get there as soon as the can.
  4. I’ve asked the tow company to increase the patrolling on the weekend.  They have confirmed they will be there more often.
  5. Grass seeding will be after the 15th. Too early will waste the HOC's money if there is a freeze.  BTW its snowing today :)
  6. Parking is a problem, I understand that.  I'm not authorized to overturn a program of this magnitude. As I've explained to numerous people the new board can change that program after the election.
  7. Street repairs are very expensive.  I will be doing some repairs in the next two months but they are limited in scope. 
  8. There are other management companies that are viable options for the Board to select after the elections. The selection process should be very deliberate.
  9. Spring Clean up begins next week weather permitting
  10. The fountains are in as expected
  11. The planter has been repaired
  12. The fence has been repaired
  13. Security camera's are repaired

Cedar Run Update - Election Ordered for May; Receiver's Report Available

We're Getting Closer.....
On February 25th, 2016, the Honorable Judge Garcia issued a Summary Judgement that included an order to conduct Cedar Run's election for an entirely new board of directors (twelve in total).  This election will be scheduled sometime in May of 2016, although an exact date has not yet been established.  More details should be available after the next hearing on 3/17.

This long-awaited election will be a great milestone for Cedar Run and opportunity for the community to heal after years of turmoil.  It will be a chance to get some much needed closure and a chance to start anew with a responsible board and management.


Bogus Bylaws Officially Void
It should come as no surprise, as the judge has made his stance quite clear on the matter of the Sher/Shaw groups "2012 Bylaws", but they have now been officially declared as void.  The original, "1972 Bylaws" will govern the election.

Again, it was clear from the very start that the Bogus Bylaws would never hold up in court.  However, the Shaw sisters (attorney's Anne & Caryn) have been fighting and trying to find an argument (more like grasping at straws) to justify these Bogus Bylaws for almost two years.  While none of their arguments had much merit, Judge Garcia still gave them a chance to make their case.....many times.  Should the Shaws appeal this decision, they will have quite an uphill battle if they intend to show they were treated unfairly by Judge Garcia.

Update from Receiver

We received the following update from the receiver regarding collections and parking.
 

Legal Collections
The Receiver has initiated  legal collection activities on over 40 owners that owe significant back assessments.

Collections began after notification of outstanding balances were provided monthly from Nov, Dec and Jan.  10 Day notices were issued and finally the delinquent accounts were  turned over to an attorney for collection.   Once an account is turned over to the attorney we no longer accept payments to the lock box nor will we discuss any delinquent accounts.  All correspondence must be sent to the attorney.  All costs associated with legal collections are assessed back to the unit owners accounts.

Parking/Towing
Over 170 parking spaces have been rented for the year, the remainder are in the process of being offered to people on the waiting list that is posted in the club house.

Wheeling Police Giving Presentation for Cedar Run Residents

Apologies for the day-of notice, but we have been informed that the Wheeling Police Crime Prevention Division will be giving a presentation this evening at the Cedar Run Clubhouse.

It will take place at 7:30PM

All residents and owners are welcome

The topic will be how to call & interact with police and how to properly file a police report.  There will also be an open forum after the presentation where everyone will have the chance to provide feedback and ask questions.
