It's Official - Cedar Run HOC Now in Receivership

As of Friday, February 13th, 2014, The Cedar Run Homeowners' Corporation (aka HOC, aka 'the Master Board', aka the Sher group) is now in receivership.

We will post a more detailed summary of the order within the next few days, but we encourage you to read through the entire order.  The order makes it very clear that Robert Sher, Jack Shaw, and all of the directors on the board have been stripped of their powers. The order states "That the sitting board of the HOC has no authority to direct the actions of the HOC." (Page 2, line 5)

We will also post more information in the coming days to help clarify what it means to be in receivership and the unique circumstances for Cedar Run.  But for now, a few points of clarification:

  • The receiver is Al Schroeder from the property management firm Heil, Heil, Smart & Golee (HHSG).  You can learn more about this firm by clicking the following link to their website:  http://www.hhsg.net
  • It is only the HOC (aka 'Master board', aka the Sher group) that are in receivership.  The eleven Phase Associations in Cedar Run ARE NOT in receivership.  This order has no effect on your Phase board or management company.
  • Homeowners are strongly encouraged to continue paying their assessments without interruption.  This must be done exclusively by mail, as the receiver will likely not allow for payment collection at the clubhouse.

Office hours have been posted at the clubhouse and will remain in effect until March 15.  There may still be staffed office hours after March 15, but those hours have not yet been announced. Homeowners are encouraged to check the clubhouse postings for the most up-to-date office hours.  We will, of course, post new information as we receive it.  We do NOT know if assessment payments will still be accepted at the clubhouse after March 15, but we hope to get clarification soon.

  1. great news on receiver for h.o.c is it going to stay h.o.c or go back to h.o.a ?I suggest this management take over the phases while we have them until the election I am sure this company is what we want and need if they get this mess under control and show us the truth on where our money went and if they show evidence of stealing money have them arrested and charges brought against every masterboard member involved suggest repay all the money spent on this elegal take over back to cedar run minimum 5 years jail time and $100.000 fine,also revoke business shers & shaw atterny lisence revoked !

    1. Couple things: The official name is and always has been Cedar Run Homeowners' Corporation (hence the HOC). Legally speaking, it is a non-profit Homeowner's Association (HOA), governed by the Illinois General Non-Profit Act. So basically the HOC is, itself, an HOA....confusing enough for you??

      From 2002-2012, the board was referring to itself as Cedar Run Homeowner's Association, which was technically not the correct NAME (because the governing documents say 'Corporation'). It was also registered with the Secretary of State as 'Association', which was incorrect. From this day forward you can rest assured that will not happen again.....but don't be fooled into believing Robert Sher's conspiracy about you 'losing your shares' in the Corporation.

      As for this management company, they won't be taking over any phases before the election, even if every phase director wanted them to. All phase management contracts require 60 days notice to terminate. 60 days puts us into mid April.......the election will be in May.

      We will see how things are handled by HHSG over the next few months. They have a daunting task ahead of them. If homeowners are happy with them and want to keep them around, they need to express that to phase directors and to anyone who plans to run for a position on the HOC board.

      It has been our position (those of us who bring you this blog) that Cedar Run needs to be united under one management company, with one payment and one phone number to call.

      This coming election will be the best chance we've ever had to make that a reality.

  2. We now need to bond.....get the correct leaders on the Master Board...that will speak and work for each owner and renter......It is going to be a long road! But.. Again..if we all bond and work together.. Cedar Run will shine once more!

  3. Can we still mail payments? Also...can information on all this please be sent to homeowners ( suggest in Spanish and English ).....A lot do not read this or go to the clubhouse.... thank you

    1. Sorry if we weren't clear on this point. Yes, you absolutely can make your payment by mail. For those who do wish to pay at the clubhouse, we suggest checking there for the latest info.

      Regarding notices, something will likely be sent out by HHSG (the receiver/management company) very soon. Details about payments will likely be included in this mailing. It has definitely been suggested to them that all homeowner communications be sent in both Spanish and English.

  4. what do we do about registering a vehicle? any change in the awful parking that we should be allowed to have company park during the day hours as we had before with old management then from 12pn-6am those with street parking can call tow truck if needed we don't need a parking attendant just better rules for us home owners also I suggest those fooling the system with 3 hang tags still not using the garage space for a vehicle be FINED YOU WANT TO USE GARAGE ITS FOR A VEHICLE YOU NO WHO YOU ARE GO PARK ON CEDAR RUN DRIVE OR GET A STOAGE UNIT COOPERATION IS NEEDED FROM YOU !!!

    1. We haven't gotten any information on whether there will be an immediate change to parking policy. This is one of the many questions we hope the receiver can answer.

      They receiver may or may not make major changes to the current parking policy, but hopefully he can give us some the basic information we need like: 1) Who to call if a vehicle is in/blocking your spot. 2) Where to obtain guest parking passes and where these guests can park. 3) What types of general parking enforcement policies/rules are currently in effect.
